Introduction:

Welcome to the 45UP Learning Management System (referred to in this document as "45UP", "we", "our"). By using or accessing our services, you agree to comply with the following terms and conditions:

  1. These ("Terms of Use") apply to all types of accounts and subscriptions offered by 45UP.
  2. The user acknowledges understanding all terms and conditions related to using the service, and their use of the service is subject to these terms, in addition to any other terms that may be applied by the site or application from time to time. The service usage guidelines and any other provisions listed on the site are considered an integral part of these terms.
  3. All educational materials uploaded by the subscriber to the site and application are considered the exclusive property of the subscriber, with copyright reserved for them.
  4. All educational materials provided by 45UP are exclusively owned by us. Teachers have the right to use and display them for educational purposes, but they are not allowed to sell or publish them on any other media.

Account Types

45UP offers six types of accounts:

  1. Teacher Account: Designed for teachers to manage and deliver courses and classes.
  2. Student Account: Designed for students to access courses, classes, and educational materials.
  3. Parent Account: Designed for parents to monitor their child's progress.
  4. Principal Account: Designed for school principals to oversee and manage school activities.
  5. Supervisor Account: Designed for supervisors to monitor and support educational processes.
  6. Admin Account: Designed for system administrators to manage platform settings and users.

Subscriptions

45UP offers two types of subscriptions:

  • Individual Account Subscription: Designed for individual users such as teachers and students, including a free one-month trial period, after which a monthly or yearly subscription fee will be charged.
  • School Subscription: Designed for schools and educational institutions, allowing multiple users to access the platform under a single subscription. The school subscription fee is determined based on the number of users and the duration of the subscription.

Use of the Platform

  1. Teachers: Can create, upload, and manage educational content and data. They must ensure that all content is original, appropriately licensed, or used under fair use guidelines. The subscriber is fully responsible for using any unlicensed materials or materials that violate others' intellectual property rights.
  2. Students: Can access and use content for educational purposes only.
  3. Parents: Can monitor their child's progress and communicate with teachers and school administrations.
  4. Principals and Supervisors: Can supervise and manage activities within their schools or regions.
  5. System Administrators: Have the authority to manage the platform responsibly, including creating student, teacher, principal, and supervisor accounts and managing all activities while ensuring compliance with all applicable laws and regulations.

Subscription Fees

  1. Individual Account Subscription: Payment is due at the end of the free one-month trial period. If payment is not made, access to the platform will be suspended.
  2. School Subscription: Fees must be paid in full at the beginning of the subscription term. Schools are responsible for managing the allocation of accounts to their users.
  3. We strive to offer transparent and clear pricing for all subscriptions and services provided by our site or application. All prices are up-to-date and include all fees related to the product or service.
  4. Please note that prices may vary based on geographic location or promotional offers. You can view current prices and available discounts through our website.

Termination and Suspension

  • 45UP reserves the right to suspend or terminate any account in case of a violation of these terms, including but not limited to illegal activities, harassment, intellectual property rights violations, or displaying illegal materials through the platform.

Changes to the Terms

  • 45UP may modify these Terms of Use at any time. Users will be notified of significant changes, and continued use of the platform implies acceptance of the new terms.

Privacy Policy

A. Information Collection:

  • We are committed to protecting your personal information. 45UP collects personal information such as name, email address, and usage data to provide and improve our services. This information is collected when users create an account, interact with the platform, or contact support.
  • We guarantee that your personal information will not be shared with third parties except as necessary to provide and improve the service or to comply with the law.

B. Use of Information: 
    Personal information is used to:

  • Provide and personalize services.
  • Communicate with users.
  • Improve the platform based on usage patterns.

C. Data Security: 

  • 45UP takes data security seriously and uses encryption, secure servers, and other measures to protect your information. However, no system can guarantee absolute security.
  • The subscriber is fully responsible for keeping login information (username, password, verification code) confidential and not sharing it with others.

D. Sharing Information with Third Parties: 
45UP does not sell or rent personal information to third parties. We may share information with trusted service providers who assist us in operating the platform, provided they agree to keep this information confidential.

E. User Rights:

F. Changes to the Privacy Policy:

  • 45UP may update this Privacy Policy. Significant changes will be communicated to users, and continued use of the platform indicates acceptance of the new policy.

Return Policy

A. Individual Account Subscriptions:

  • Free Trial: The first month is free. Users can cancel the subscription at any time during the trial period without any charges.
  • Refund Policy: Once the subscription fee is charged after the trial period, it is non-refundable. Users can cancel future renewals at any time.

B. School Subscriptions:

  • Refund Policy: School subscriptions are non-refundable. Schools may cancel the subscription at any time, but no refunds will be provided for unused time.

C. Cancellation:

  • Users can cancel their subscriptions through their account settings, but the cancellation will take effect at the end of the current billing period.

Legal Violations

A. Compliance with Laws:

  • All users must comply with applicable local, national, and international laws while using 45UP. Illegal activities, including but not limited to copyright infringement, harassment, or fraud, are strictly prohibited.

B. Reporting Violations:

  • To ensure that the 45UP platform remains a safe and effective tool for its intended purposes, users must report any violations of the law or these terms. Reports can be made through the platform's reporting feature or by contacting support@45UPS.com. support@45UPS.com.

C. Consequences of Violations:

  • Investigation: 45UP will investigate any reported violations and take appropriate action, which may include suspending or terminating the offending account.
  • Legal Action: 45UP reserves the right to cooperate with legal authorities and take legal action against users who engage in illegal activities.
  • Account Suspension/Termination: Accounts involved in violations may be suspended or terminated without prior notice.
